1. ACCEPTANCE OF TERMS

By accessing, browsing, or making a purchase on thescenthero.com (the "Website" or "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Website or purchase products from us.

These Terms apply to all users of the Website, including but not limited to browsers, customers, vendors, and contributors.

2. USE LICENSE

The Scent Hero grants you a limited, non-exclusive, non-transferable license to access and use the Website for the purpose of:

  • Making purchases
  • Reading product information
  • Communicating with customer support

You agree NOT to:

  • Reproduce, distribute, transmit, or display any content from the Website without permission
  • Modify, translate, or create derivative works of the Website

3. PRODUCTS AND DESCRIPTIONS

3.1 Product Information

All product descriptions, images, prices, and specifications on the Website are provided for informational purposes. We make every effort to ensure accuracy, but we do not guarantee that descriptions, pricing, or product availability are entirely accurate, complete, or error-free.

3.2 Product Type - Decanted Samples

The Scent Hero specializes in selling decanted fragrance samples (typically 3ml-5ml). All products listed on the Website are:

  • Decanted portions of larger fragrance bottles
  • Authentic fragrances from legitimate manufacturers
  • Sold in sample/trial sizes
  • NOT full-size bottles unless explicitly stated

By purchasing from our Website, you acknowledge and agree that you understand you are purchasing a sample-sized decant, not a full-size fragrance bottle.

3.3 Fragrance Variations

Fragrance formulas may vary slightly between production batches and suppliers. Minor variations in scent profile, color, or consistency are normal and do not indicate a defect or authenticity issue. Scent experiences vary based on individual skin chemistry, body temperature, body pH, and personal perception.

3.4 "Inspired By" Product Naming

Many of our fragrances are inspired by popular luxury or designer fragrances. When we describe a product as "inspired by" another fragrance, we mean it shares similar scent profiles or notes, NOT that it is produced by, affiliated with, or endorsed by the original brand. We are an independent vendor and are not affiliated with, endorsed by, or authorized by any fragrance brands we reference.

3.5 Ingredient and Allergen Information

Fragrances contain multiple ingredients, some of which are known allergens. The EU recognizes 26 fragrance allergens. Before purchasing, please:

  • Review all available ingredient information provided in the product description
  • Research fragrance notes and known allergens if you have sensitivities
  • Contact us if you need additional ingredient information

The Scent Hero is not responsible for allergic reactions or adverse effects resulting from fragrance use. If you have fragrance sensitivities, allergies, or skin conditions, consult with a dermatologist before using fragrance products.

3.6 Price and Availability

  • Prices are subject to change without notice
  • We reserve the right to limit quantities purchased
  • Products are available while supplies last
  • We reserve the right to discontinue any product at any time

4. ORDERING AND PURCHASE TERMS

4.1 Order Placement

By placing an order on the Website, you are making an offer to purchase products on the terms stated in these Terms and on the Website. Placement of an order does not constitute our acceptance of your offer. We will send you an email confirmation when we accept your order and process payment.

4.2 Eligibility

You must be at least 18 years old to purchase from The Scent Hero. By placing an order, you represent that you are of legal age and have the authority to enter into a binding contract.

4.3 Accuracy of Information

You agree to provide accurate, current, and complete information when placing an order, including:

  • Name
  • Email address
  • Shipping address
  • Billing address (if different)
  • Payment information

You are responsible for any consequences of inaccurate information provided.

4.4 Right to Refuse Orders

We reserve the right to refuse, cancel, or limit any order for any reason, including:

  • Unavailability of products
  • System errors or pricing errors

5. PAYMENT TERMS

5.1 Accepted Payment Methods

We accept payment through:

  • Debit cards
  • PayPal
  • Other payment methods as made available through Shopify

5.2 Billing

  • Payment is processed immediately upon order placement
  • You authorize The Scent Hero and our payment processor (Shopify) to charge your payment method for the full order amount, including applicable taxes and shipping fees
  • Your payment information is processed securely through Shopify and is not stored on our servers

5.3 Currency

All prices are displayed in USD (United States Dollars). If you are paying from outside the United States, your bank or payment processor may apply currency conversion fees, which are your responsibility.

5.4 Billing Disputes

If you believe there has been a billing error, you must contact us at thescenthero@gmail.com within 30 days of the transaction. Disputes not reported within 30 days are forfeited.

5.5 Chargebacks

If you initiate a chargeback or payment dispute without first attempting to resolve the matter with us, you authorize us to:

  • Suspend your account
  • Refuse future orders
  • Pursue legal remedies available to us

6. SHIPPING AND DELIVERY

6.1 Shipping Addresses

We only ship to addresses within the continental United States. Shipping to PO boxes, APO addresses, or addresses outside the US is not available.

6.2 Shipping Methods and Timeframes

  • Standard Shipping: 5-7 business days (after order processing)
  • Expedited Shipping: 2-3 business days (if available)
  • Processing time: Orders are processed within 1-2 business days

These are estimates only. The Scent Hero is not responsible for delays caused by:

  • Carrier delays
  • Weather conditions
  • Natural disasters
  • Government actions
  • Other unforeseen circumstances

6.3 Risk of Loss

Risk of loss transfers to you once the carrier picks up your package. We recommend purchasing shipping insurance for valuable orders.

6.4 Delivery Confirmation

We provide tracking information via email. You are responsible for monitoring your shipment. If a package is marked as delivered but not received, contact us and we will work with the carrier to investigate.

6.5 Undeliverable Packages

If a package is returned to us as undeliverable (wrong address, refused delivery, etc.), we will contact you. You are responsible for any reshipping costs.

7. RETURNS, EXCHANGES, AND REFUNDS

7.1 No Returns or Exchanges - Final Sale

ALL SALES ARE FINAL. We do not accept returns, exchanges, or refunds on any products for the following reasons:

  • Fragrances are personal care items
  • For health and safety reasons, we cannot accept opened or used fragrance products
  • Scent preferences are subjective and personal
  • Once delivered, products cannot be resold

7.2 Exceptions (Limited)

The only exception to our final-sale policy is:

Defective Products: If you receive a product that is:

  • Leaking or damaged due to our packaging
  • Non-functional (pump/sprayer not working)
  • Contaminated or obviously defective

You must notify us within 7 days of delivery with photos of the damage. We will, at our sole discretion, either:

  • Send a replacement product
  • Provide a store credit equal to the product price
  • Issue a refund

This exception does NOT apply to:

  • Scent dissatisfaction
  • Wrong product expectations
  • Change of mind
  • Product not matching a description (subjective impression of scent)

7.3 Refund Timeline

If a refund is approved, it will be processed within 5-7 business days. Depending on your payment method and bank, the refund may take an additional 3-5 business days to appear in your account.

8. INTELLECTUAL PROPERTY RIGHTS

8.1 Website Content

All content on the Website, including:

  • Text
  • Images
  • Graphics
  • Product photos
  • Logos
  • Design elements

...is the property of The Scent Hero or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

8.2 License to Use Website Content

We grant you a limited license to view and print materials from the Website for personal, non-commercial use only. You may not:

  • Republish content without permission
  • Copy/paste product descriptions for resale
  • Use our photos on other websites
  • Modify or create derivative works

8.3 Third-Party Trademarks

References to fragrance brands, brand names, or trademarks on the Website (e.g., "Louis Vuitton Inspired," "Dior," "Creed") are used for product identification purposes only. 8.4 User-Generated Content

  • Non-infringement of third-party rights
  • Uninterrupted or error-free access

9.2 Limitation of Damages

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE SCENT HERO BE LIABLE FOR:

The Scent Hero is not responsible for any personal injury, property damage, or other harm resulting from product use. Use fragrance products as directed and discontinue use if irritation occurs.

9.4 Third-Party Services

The Website is hosted by Shopify. Shopify's Terms of Service apply to the hosting and operation of the Website. We are not responsible for:

  • Shopify outages or service interruptions
  • Payment processing errors (contact Shopify)

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless The Scent Hero, its owners, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from:

  • Your violation of applicable law
  • Your infringement of third-party rights
  • Your product claims or injury claims

11. DISPUTE RESOLUTION AND GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. You agree that California law will apply to any dispute, regardless of your location.

11.2 Jurisdiction and Venue

You irrevocably submit to the exclusive jurisdiction of the state and federal courts located in Orange County, California for any legal proceedings arising from these Terms or your use of the Website.

11.3 Informal Resolution

Before initiating any legal action, you agree to attempt to resolve any dispute informally by contacting us at thescenthero@gmail.com with:

We will respond within 30 days. If we cannot resolve the matter informally, you may pursue legal remedies.

We reserve the right to suspend or terminate your account if:

Account termination will result in loss of access to your account history and any pending orders will be canceled.
